Terms and Conditions

Website Terms and Conditions of Use Relating to www.loomband.co.za a division of Amkay Technologites (Pty) Ltd a company incorporated in the Republic of South Africa.
These Terms and Conditions (“the Terms and Conditions”) govern your (“the User”) use of the Loomband online Amkay Technologites (Pty) Ltd (“Provider”) website located at the domain name ww.Loomband.co.za (“the Website”). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider.

Credit Card Security
Payment may be made via Visa, MasterCard, Diners or American Express credit cards or by bank transfer into the the Provider’s bank account, the details of which will be provided after checkout. Credit card transactions will be acquired for the Provider via approved payment gateways. Our payment gateways use the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Customer details will be stored by the Provider separately from card details

Cancellation & returns Policy

Non-defective Products
For certain exceptional cases (as listed below), you are entitled to cancel any purchase made via the Loomband  website within 7 days after your receipt of the product/s and to obtain a full purchase price refund, subject to being charged by the seller thereof for the initial delivery cost of the product and which must occur by following the returns procedure set out in the ‘Processing Returns’ section below.  Although seldom charged, we reserve the right to charge a 10% administration fee for returned orders should the returns process incur significant administration or delivery expenses.
Please note that although you are entitled to cancel your purchase as aforesaid, you must return the product un-opened and in the condition you received it, therefore do not remove the product form its original packaging as Rapit may hold you liable for any damage you casut to the product and or its packaging while in your possession.

Incorrect Product:
If the incorrect product is delivered to you by a mistake, please do not remove the product from its original packaging, open or use the product in any way.  Contact Loomband immediately to replace the incorrect product.
Late Delivery:
If a product purchased is not shipped within the agreed delivery period, or where no specific period was agreed, within 21 days after having purchased the Product, the ECT Act entitles you to cancel such a sale on 7 days’ notice to the seller of such product, via email notification to returns@loomband.co.za
Defective / Damaged / Unsuitable products:
If you find that the product is defective / faulty / damaged and you arrange to return such a product to Loomband for inspection as per “processing returns” section below and the product is subsequently found:
•    to indeed be defective / faulty / damaged, you are entitled to either have the product repaired / replaced / refunded
•    Not to be defective / faulty / damaged, you will be liable for the costs incurred in having such product returned to Loomband and then re-delivered back to you.
Please note that the following will NOT render the product defective / faulty / damaged, as aforesaid and will not entitle you to any repair / replacement / refund.
– Faults resulting from normal wear and tear
– where a person unauthorized by Loomband has altered or damaged the product
IMPORTANT:  You should refuse to accept delivery of any product which is visibly damaged, and if you only discover the damage after the courier has left, then you should report it to Loomband as soon as possible and within 48 hours. If only reported after 48 hours, it is reasonable for Loomband or its suppliers to determine that the damage was caused post-delivery.

Early Cancellations
You are entitled to cancel (either in whole or in part) any sale without attracting any cancellation and/or administration charges if you cancel prior to the packaging of the products so sold, except for the purchase of ‘made to order’ and personalized products where production has begun.  Such early cancellations can only be effected via email notification to returns@ Loomband.co.za

Products and Availability
Subject to stock availability and receipt of payment, requests will be processed within 1 – 2 working days and handed over to a courier company for delivery. Should Loomband.co.za be unable to fulfil any order placed by you due to stock having sold out you will be entitled to a full refund. Unless otherwise specified, delivery is free for all orders over R350. For very remote areas not serviced by standard couriers, The Provider will deliver via Post Office, or to the nearest town to the User that is accessible by the Providers courier within their normal routes. In these circumstances the Provider will be in contact with the User to arrange an alternate address.

The Provider will supply all goods to the courier in good order and cover the cost of insurance, should in the event goods arrive at the chosen delivery address damaged the Provider will assist with a claim with the courier and will replace the damaged goods.
Cancelled orders on the e-commerce facility will be refunded after deduction of a 10% charge for administration costs. The Provider reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet the Providers standards. Should the Provider exercise this right, the User will receive a full refund with no deductions.
Any complaints regarding the standard and quality of the product or products bought by consumers through the e-commerce facility should be directed to the Purchasing Manager, P.O Box 1194, Bedfordview, 2007, or info@Loomband.co.za.

Delivery Times

Provider uses the services of Fastway, speed services and Worldnet express.
Once an order is dispatched to one of the above mentioned couriers the provider will give the purchaser a tracking number.  Delayed deliveries are not the responsibility of the provider and it is up to the purchaser to follow up with the courier using their tracking number.

Provider shall take all reasonable efforts to accurately indicate Purchase Prices and delivery charges. However, should Products be erroneously offered at incorrect Purchase Prices and/or delivery charges, provider will not be obliged to sell Products at such incorrect Purchase Prices and/or delivery charges and shall only be liable to refund monies paid should you not wish to proceed with the Purchase at the correct Purchase Price and/or delivery charge.

Copyright and Intellectual Property Rights
Provider provides certain information at the Website. Content currently or anticipated to be displayed at this Website is provided by Provider, its affiliates and/ or subsidiary, or any other third party owners of such content, and includes but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematograph Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions and Computer Programs (“The Content”). All such proprietary works, and the compilation of the proprietary work, are copyright the Provider, its affiliates or subsidiary, or any other third party owner of such rights (”The Owners”), and is protected by South African and International copyright laws. The Providers reserve the right to make any changes to the website, the Content, or to the products and/ or services offered through the Website at any times and without notice. All rights in and to the Content is reserved and retained by the Owners. Except as specified in these Terms and Conditions, the User is not granted a license or any other right including without limitation under Copyright, Trademark, Patent or other intellectual Property Rights in or to the Content.

Limitation of Liability
The Website and all Content on the Website, including any current or future offer to products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors.  The Owners make no warranty or representation as to the availability, accuracy, or completeness of Content. Neither Provider nor any holding company, affiliate or subsidiary of Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if Provider is expressly advised thereof.

Privacy Policy

We respect your privacy and ensure all the necessary steps to protect the personal information you give us. The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties.
Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product. We will only contact you for marketing if you have given us your consent. You may elect to unsubscribe from our marketing communication at any time. The Provider undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold.
The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

What we collect
We may collect the following information:

•     – demographic information such as postcode, preferences and interests
•     – other information relevant to customer surveys and/or offers

What we do with the information we gather
We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

Private surfing
The User may visit the Website without providing any personal information. The Website servers will in such instances collect the IP address of the User computer, but not the email address or any other distinguishing information. We reserve the right to modify and change the Terms and Conditions at any time. Any changes to this policy will be published on our site.
